What is “Subtitle B of Title VII” of OBBBA?

• The “One Big Beautiful Bill Act” (often shortened to OBBBA) is the reconciliation / budget package passed earlier in 2025.

• Title VII of OBBBA deals with immigration / citizenship / alien status provisions.

  Subtitle B within Title VII includes health‐related changes about how eligibility for Medicaid, ACA premium tax credits, and Medicare benefits is determined based on a person’s immigration or “alien” status. 

In simpler terms: Subtitle B put into law restrictions on which non-citizens or non-lawfully present immigrants (or certain categories thereof) can access Medicaid, Medicare, and ACA subsidies.

Key provisions in Subtitle B of Title VII (OBBBA) that Democrats want to repeal

From analyses and the text of the Democratic proposal:

1. Narrowing Medicaid “alien” eligibility (Sec. 71109 in OBBBA)

   • Changed the definitions / terminology used to determine whether noncitizens qualify for Medicaid.

   • Restricted eligibility to U.S. citizens, lawful permanent residents (LPRs), certain Cuban/Haitian entrants, and individuals under the Compact of Free Association (e.g. Micronesia, Marshall Islands).

   • Previously, a broader set of “qualified aliens” (which included asylum seekers, parolees, etc.) could have some access.
